Please read it carefully because it sets out the terms of a legally binding agreement between you and Caixin. If you choose to use Caixin services, you will be agreeing to abide by all of the items of this Terms and Conditions between you and Caixin. If any of these items or any future changes are unacceptable to you, you may cancel you membership.
1. General introduction
Caixin provides content and services under this rule and any future modifications to it. If you choose to use Caixin services, you will be agreeing to abide by all of the items of this Terms and Conditions between you and Caixin.
2. Access and use
Users should make sure they have applicable devices and internet connections (personal computers, laptops, tablets or mobile phones) to obtain the content and services we provide. Make sure that you have paid the bills for electricity supply, internet use or mobile data.
Users should provide accurate and complete personal information to access valuable and personalized services. You should update it if there is any change.
3. Cancellation and renewal
Caixin will from time to time develop or upgrade the management system of digital platforms in order to improve user experience and service quality. If there is any bug or interruption of the platforms amid system upgrading, we will fix them as soon as we can. We will not be responsible for short-time suspension of online operation.
Due to the unique nature of online operation, users agree that Caixin has the rights to upgrade, suspend, or terminate our services at any time and does not take any duty for users or any third party. We will suspend or terminate services to a user if:
i. The user provides untrue information;
ii. The user violates rules in this Terms and Conditions;
iii. The user doesn’t pay for the services on time.
4. Registration
As part of the registration or account creation process, you will create login credentials by selecting a password and providing an e-mail address. You also have to give us certain registration information, all of which must be accurate and updated. Each registration is for a single user only. You are not allowed to share your registration login credentials or give your login credentials to anyone else. We may cancel or suspend your access to Caixin if you share your login credentials. You are responsible for all usage or activity on your Caixin account, including use of the account by any third party authorized by you to use your login credentials.
Registered users hereby agree that Caixin can deliver promotions and recommendations or other relevant commercial information.
We occasionally provide statistical, demographic and marketing analyses of users of Caixin, and their subscribing and purchasing patterns, for product upgrading purposes and to generally inform advertisers about the nature of our user base, without disclosing any individual user’s information.
5. Your account
You may change the password at any time, but are responsible for keeping your login credentials secure. You are not allowed to share your registration login credentials or give your login credentials to anyone else. We may cancel or suspend your access to Caixin if you share your login credentials. If you find any security loopholes in terms of your login credentials, you should contact us. Caixin is not responsible for account leaks due to users’ carelessness or hacking.
6. Purchase and refund
Caixin offers digital access of certain content to paid subscribers. Any purchase or subscription transactions completed through Caixin’s digital platform is nonrefundable. If you subscribe to our service, you may cancel the subscription anytime and charges will cease at the next billing period.
7. Privacy
We are committed to safeguarding the privacy of our users. We will not sell, rent, swap or authorize any third party to use your private information without your permission. except the following conditions:
i. When a user allows us to use the information;
ii. When a law or regulation requires;
iii. For public securities concerns;
iv. When we have to preserve our integrity and legality.
8. User management
Users should obey the following rules:
i. Obey relevant laws and regulations of the People’s Republic of China;
ii. Obey relevant agreements, terms and policies released by the service provider;
iii. Use the services on legal purposes;
iv. Not upload to, or distribute or otherwise publish on to Caixin any libelous, defamatory, obscene, pornographic, abusive, inciting or otherwise illegal material;
v. Not threaten or verbally abuse other users, use defamatory language, or deliberately disrupt discussions with repetitive messages, or meaningless messages.
vi. Not use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc.
vii. Not distribute any unconfirmed or uncertain information that may cause social disorder or damage public interest;
viii. Not violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights;
ix. Not damage the interest of Caixin;
x. Not interrupt or cause disorder of the internet service;
xi. No hacking.
You are responsible for all usage or activity on your Caixin account, including use of the account by any third party authorized by you to use your login credentials. If you violate any of the rules above, or conduct other inappropriate behaviors, Caixin will take measures including but not limited to: block or delete the messages; lock the account (stop it from posting or visiting the website); suspend, terminate or remove the account. If you stop spreading illegal messages, we may consider re-activate your account.
If you upload to, or distribute or otherwise publish on to Caixin any obscene, pornographic, inciting or otherwise illegal material, we may use it as a proof for legal actions.
Caixin is not responsible for any deleted information or failed saves of users. We are able to judge if a user violates relevant laws or regulations and may terminate the service to such users.
Users agree to grant Caixin the right to use, copy, change, edit, publish, translate, adapt, distribute, perform and display within the whole world any content and message that users upload on the open platforms of Caixin, and/or merge the content with other works and technology.
9. Content ownership
The contents of the services include but not limited to texts, photographs, images, illustrations, audio and video clips, graphics, software and advertising. All the contents are protected by copyright, trademark,and law. Users shall not copy, publish, repost, play, adapt, compile or conduct other means to use the content for commercial use.
10. Links
Our platforms contain links to other related websites, webpages, resources, and advertisers. Since we are not responsible for the availability and potential risks of accessing these outside resources, or their contents, you should direct any concerns regarding any external link to such site.
11. Disclaimer
Users agree to bear potential risks and consequences of using the services provided by Caixin. We don’t guarantee to satisfy all users or have no suspension or interruption of the services, or ensure the security, accuracy or punctuality of the services. We will make sure to mitigate the loss of users as much as we could.
12. Compensation duty
Caixin agrees to protect the interest of our users. But if you violate laws, regulations or this Terms and Conditions and cause damage to us or any third parties, you shall compensate the damage; Caixin is not responsible for any direct, indirect, accidental, special or consequent loss caused by users. The loss may result from but not limited to the following activities:
i. Using the internet inappropriately;
ii. Making online purchases or similar transactions;
iii. Using the services illegally;
iv. Providing wrong information for any premium services.
13. Changes to Terms and Conditions
From time to time we may modify this Terms and Conditions. We will post the latest version on this page and we suggest you access it occasionally because we will not notify you on any updates. We will not change the old way of managing users before the change is made.
14. Applicable laws
The establishment, enforcement, explanation and dispute settlement of the Terms and Conditions shall abide by the laws of the People’s Republic of China and be adjudicate by China’s courts. If any rule of this Terms and Conditions conflicts with laws, we’ll amend the rule particularly while other rules still maintain their legality.
If two sides have disputes over the content or enforcement of the rules, they should negotiate first. If negotiation doesn’t work, either side can file a suit at the People’s Court where Caixin is based.
15. Others
We phrase the names of the rules just for convenience when writing and reading them. They should be neglected during explanation.
